RunnerReach and our B2B clients (brands, event organizers, businesses). By using our services, you agree
to these Terms.
1. Agreement to Terms
By accessing our website, submitting an inquiry, or engaging our services, you ("Client," "you," or "your")
agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree
with any of these terms, you are prohibited from using our services.
2. Services Overview
RunnerReach provides the following services to business clients:
- Targeted Email Marketing Campaigns: Sending promotional emails to specific athlete segments on behalf of clients
- Performance Affiliate Marketing: Promoting client products to athletes with commission-based compensation
- Audience Insights & Data Analytics: Providing aggregated, anonymized reports about runner demographics and behavior
- Custom Audience Targeting: Helping clients identify and reach specific athlete segments
3. Client Responsibilities
3.1 Accurate Information
Clients must provide accurate, complete, and current information when requesting services, including:
- Company name and contact information
- Campaign goals and target audience specifications
- Marketing content and creative materials
- Product information for affiliate campaigns
3.2 Content Guidelines
All content submitted for email campaigns must:
- Be truthful, accurate, and not misleading
- Comply with all applicable laws, including FTC advertising guidelines
- Not contain illegal, offensive, discriminatory, or harmful content
- Not promote prohibited products (illegal substances, weapons, adult content, etc.)
- Include accurate product descriptions and pricing
- Honor any advertised offers and discounts
3.3 Compliance
Clients agree to:
- Comply with CAN-SPAM Act requirements and all email marketing regulations
- Respect athlete opt-out requests and our suppression lists
- Not attempt to access or obtain athlete email addresses or personal data
- Fulfill all product orders and services advertised in campaigns
4. Service Terms and Pricing
4.1 Targeted Email Campaigns (Pay-Per-Send)
- Pricing: $0.20 - $0.40 per email sent (final rate determined by campaign volume, targeting complexity, and client relationship)
- Payment: Due before campaign launch unless credit terms are pre-approved
- Minimum Campaign: 1,000 emails
- Delivery: We guarantee delivery attempts to all targeted athletes; actual open/click rates depend on content quality and audience engagement
4.2 Performance Affiliate Marketing
- Commission: 5-15% of gross sales generated through RunnerReach campaigns (rate negotiated per partnership)
- Tracking: Client must provide affiliate tracking links or pixels
- Payment: Commissions paid monthly, net 30 days after month-end
- Minimum Payout: $100 (balances below minimum roll over to next month)
4.3 Data Insights & Reports
- Custom Reports: $200 - $2,000 depending on scope and complexity
- Subscription Access: Custom pricing for ongoing access to insights dashboard
- Delivery: Reports delivered within 5-10 business days of order
4.4 Refund Policy
- Email Campaigns: Refunds available if we fail to deliver the agreed-upon number of emails due to technical issues on our end. No refunds for low engagement or poor campaign performance.
- Affiliate Campaigns: No fees charged upfront, so no refunds applicable
- Data Reports: Refunds available if report is not delivered or does not meet agreed-upon specifications
5. Intellectual Property
5.1 Client Content
Clients retain ownership of all content, branding, and materials provided to RunnerReach. By submitting
content, clients grant RunnerReach a limited license to use, reproduce, and distribute the content solely
for the purpose of executing agreed-upon campaigns.
5.2 RunnerReach Property
RunnerReach retains all rights to our data, technology, reports, and methodologies. Clients may not:
- Reverse-engineer our targeting algorithms or data processing methods
- Copy, reproduce, or redistribute our reports to third parties without permission
- Use our brand name or logo without written authorization
6. Data and Privacy
6.1 Data Ownership
RunnerReach owns all athlete data. Clients do not acquire ownership or direct access to athlete email
addresses, names, or personal information. All email campaigns are sent by RunnerReach on behalf of clients.
6.2 Data Protection
Clients must:
- Not attempt to scrape, harvest, or collect athlete data from our communications
- Comply with all applicable privacy laws when providing us with customer data for targeting or tracking
- Maintain confidentiality of any aggregated insights or reports provided
6.3 Compliance
RunnerReach complies with CAN-SPAM, CCPA, GDPR (where applicable), and other data protection laws.
All athletes have consented to receiving marketing communications per our partner application's privacy policy.
7. Performance and Guarantees
7.1 Delivery Guarantees
We guarantee:
- Emails will be sent to the agreed-upon number of targeted athletes
- Campaigns will be delivered within the agreed timeline (typically 3-5 business days from approval)
- All targeting criteria will be accurately applied
7.2 No Performance Guarantees
We do NOT guarantee:
- Specific open rates, click rates, or conversion rates
- Sales results or revenue generation
- ROI or return on advertising spend
Campaign performance depends on content quality, offer attractiveness, brand reputation, and audience
engagement—factors outside RunnerReach's control.
8. Limitation of Liability
To the maximum extent permitted by law, RunnerReach shall not be liable for any indirect, incidental,
special, consequential, or punitive damages, including lost profits, lost revenue, or lost data, arising
from or related to these Terms or our services.
Our total liability for any claims arising from our services shall not exceed the amount paid by the
client for the specific service giving rise to the claim.
9. Indemnification
Client agrees to indemnify, defend, and hold harmless RunnerReach from any claims, damages, losses, or
expenses (including attorney fees) arising from:
- Client's violation of these Terms
- Client's violation of any law or third-party rights
- Content provided by client (false advertising, copyright infringement, etc.)
- Client's products or services advertised through our platform
10. Termination
10.1 By Client
Clients may cancel campaigns before launch for a full refund. Once a campaign is launched, no cancellation
or refund is available unless we fail to deliver as agreed.
10.2 By RunnerReach
We reserve the right to refuse service or terminate client relationships if:
- Client violates these Terms
- Client provides false, misleading, or illegal content
- Client engages in abusive or harassing behavior toward our staff
- Client's campaigns generate excessive complaints or opt-outs
- Payment is not received as agreed
11. Modifications to Terms
RunnerReach reserves the right to modify these Terms at any time. Updated Terms will be posted on this page
with a new "Last Updated" date. Continued use of our services after changes constitutes acceptance of the
updated Terms.
12. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of [Your State/Country], without
regard to its conflict of law provisions.
Any disputes arising from these Terms or our services shall be resolved through binding arbitration in
